1. We respect intellectual property

ClassDay responds to valid copyright complaints about material stored in a user's account and will remove or disable access to material that is the subject of a proper notice.

2. Your uploads are your responsibility

Uploading a file does not transfer ownership to us and does not make us the owner of your syllabus, slides or readings. You keep your rights; we hold and process the file only to run the service for you, as described in the Terms. You are responsible for having the rights or permission to upload what you upload.

3. Sending a takedown notice

A notice should be in writing and include all of the following:

  1. a physical or electronic signature of the copyright owner or a person authorised to act for them;
  2. identification of the copyrighted work claimed to be infringed;
  3. identification of the material claimed to be infringing, with enough detail for us to locate it;
  4. your name, postal address, telephone number and email address;
  5. a statement that you have a good-faith belief the use is not authorised by the owner, its agent or the law; and
  6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorised to act on the owner's behalf.

Send it to the agent below. Signed-in users can also file a report from Settings → Report a problem, choosing the copyright option; a written notice with the elements above is still required for formal takedown.

4. Sending a counter-notice

If your material was removed and you believe that was a mistake or misidentification, you may send a counter-notice containing:

  1. your physical or electronic signature;
  2. identification of the removed material and where it appeared before removal;
  3. a statement, under penalty of perjury, that you have a good-faith belief it was removed as a result of a mistake or misidentification;
  4. your name, address and telephone number; and
  5. a statement consenting to the jurisdiction of the appropriate court and to accept service of process from the complaining party.

Where the law provides for it, we may restore the material after the statutory waiting period unless the complainant notifies us that they have filed a court action.

5. Designated agent

For counsel: designate the agent and, where applicable, register the designation with the US Copyright Office before relying on safe-harbour protection.

6. Repeat infringers

We keep a record of complaints and, in appropriate circumstances, disable features or terminate the accounts of users who repeatedly upload infringing material.

7. Misrepresentation

Knowingly making a material misrepresentation in a notice or counter-notice can expose you to liability for damages, including costs and legal fees. If you are unsure whether the material is infringing, speak to a lawyer first.
